These terms and conditions are provided by MCW Gear or Hamtons Direct Limited (referred to as 'us', 'our' or 'we' in these terms) and set out the terms and conditions under which you may use our website. Your use of this website constitutes acceptance of these terms and conditions.
These terms and conditions may be revised at any time by us updating the website. Changes to these terms and conditions will be effective immediately when they are posted on the website. We reserve the right to close any, or all, of the website at any time, and to amend or correct any website content, with or without prior notice.
We reserve the right to change prices or update descriptions at any time without prior notice. Any orders received represent an offer to buy products indicated by you. This is not a binding contract until we accept the order and dispatch the products.
A contract is formed between us when (and not before) we dispatch your order. The order will not be accepted until we receive payment.
Any errors regarding website based information, quotations, price lists, acceptance of offer, invoice or other documentation or information issued by us may be subject to correction without any liability on our part.

By clicking ‘Confirm Order’ you are confirming your acceptance of these terms and conditions and that you are giving us permission to make a debit for this order.
E-mails sent will be deemed as read, it is your responsibility to ensure that the email address supplied is accurate and capable of receiving our e-mails.

We reserve the right to vary these terms and conditions at any time but, in respect of any ordered goods, the terms and conditions, which apply, shall be those, which the customer has accepted when an order has been placed. Once an order is placed customers are deemed to have read and agreed to the terms and conditions. This agreement together with the standard terms and conditions of the website constitutes the entire agreement between you and the MCW Gear or Hamtons Direct Limited with respect to the use of the website.
Description of products
We take all reasonable care to ensure that all product details and descriptions are correct on our website. All products sold on our website are brand new. We DO NOT sell used or refurbished items unless stated. All the products conform to relevant European Safety standards.
Stock Availability
Usually everything displayed on our site is in stock unless otherwise stated. If for any reason the product you ordered is not available, we will contact you and let you know as soon as possible. MCW Gear or Hamtons Direct Limited is not legally bound to supply the product until we accept your order and despatch. We are happy to put items on back order for you, but will contact you again before dispatch.
PRICE & PAYMENT
The Price and payment terms are set out in the Confirmation of Order. The price displayed at time of purchase is the price you will pay and will not be affected by price increases or decreases. We are unable to offer a discounted price should the price of an item decrease after you make your purchase.
We accept PayPal only. If payment is not received within 7 working days, an unpaid item case will be automatically open by eBay.
We reserve the right to decline PayPal payments with unverified account or unconfirmed address. Due to seller protection policy we only send to addresses registered with eBay and PayPal. If you wish an item to go to different addresses you must use different method of payment other than PayPal.
All prices quoted are exclusive of VAT.
VARIATIONS
If the Purchaser wishes to change anything in the Order, the request must be made in writing through eBay messaging system. The Seller will inform the Purchaser whether it is willing to agree to the change and, if so, what will be the impact on the price and delivery date. The Purchaser must notify the Seller in writing within 2 days if these changes are accepted and if so, the price and delivery date will be adjusted by the Seller. The Seller will not proceed with the change until this notice is received. A request to reduce the quantity of Products ordered will not result in a price reduction unless otherwise agreed in writing by the Seller.
DELIVERY
We normally dispatch within 24 hours after receiving cleared payment, using Royal Mail, UPS and myHermes Services. We post Monday to Friday excluding Bank Holidays.
All delivery dates given by the Seller are given in good faith but dates are not guaranteed and the Seller will not be liable to the Purchaser for any delay in delivery.
The Seller will notify the Purchaser when the Products are ready for delivery. Delivery will occur when the Purchaser collects (or arranges collection) of the Products from the Seller's premises, unless different delivery arrangements are agreed in the Order (at the Purchaser’s expense). If the Purchaser does not collect the Products within 7 days of the delivery date the Seller may charge a reasonable amount for storage pending collection by the Purchaser.
We obtain Proof of Postage for every order sent that has detail of your address and weight of the item sent. Please note that once orders are posted then it is the courier companies’ responsibility. Any item that gets damaged or lost in the post will need to be claimed for through the courier company’s Insurance and orders would not be re-sent until a claim is satisfied by the courier company. If the item is no longer available we will offer you a replacement one or give refund. Claims are not accepted by Royal Mail unless 15 working days has passed from the day an item was sent.
Packaging and Postage charge (P&P) represent the actual cost of shipping, packaging material, and labour cost.
Any international buyers need to contact us for shipping cost before placing an order. All international orders paid via PayPal are sent as recorded delivery. If you do not wish to pay for recorded delivery you must use direct bank transfer as method of payment. Please note that we cannot be responsible for items lost that were sent as non-recorded delivery (upon your request) and therefore, we are unable to offer you a replacement or a refund.
OWNERSHIP & RISK
The risk of loss or damage to the Products passes to the Purchaser upon delivery or 7 days after the Seller has notified the Purchaser that the Products are ready for collection at its premises if the Purchaser has not collected them by then.
Ownership in the Products will remain with the Seller until payment in full of all amounts due from the Purchaser have been received by the Seller.
WARRANTY & LIABILITY
14 day money back guarantee with no restocking fee (P&P is not refundable and if the item had free delivery, an admin charge of £4.99 will apply). Buyers are responsible of all shipping charges on returned items. There is no other warranty service other than this 14 days money back guarantee.
The Seller will exercise reasonable skill and care in the manufacture or preparation of Products (where applicable).
Any defects should be notified within 7 days of delivery and the defective Product returned to the Seller at the Purchaser’s expense. When the Seller accepts that the defect is due to faulty workmanship or materials the Seller will have the option either to repair or replace the defective Product.
The warranty given above will not apply to defects which are due to: fair wear and tear, accidental damage or failure by the Purchaser to adhere to the Seller’s recommendations.
FORCE MAJEURE
The Seller will not have any liability to the Buyer if prevented from performing the Contract on account of force majeure which includes, but is not limited to severe weather conditions, war, terrorism, strikes or difficulty in obtaining materials and labour. In any of these circumstances, the Seller reserves the right to cancel or delay the Order.
INTELLECTUAL PROPERTY
All designs and intellectual property rights in Products are and will remain the sole property of the Seller. Under no circumstances will the Purchaser copy or make use of any of the Seller’s designs and other intellectual property rights.
Privacy Policy
Your privacy is very important to us. We will never release your personal details to any company outside for mailing or marketing purposes. We do not sell, trade or rent your personal information to others.
You can visit the site without giving any information about yourself, but whenever you make a purchase through credit or debit card we will ask for the usual details in any standard transaction including your name, e-mail address, delivery address, credit or debit card number, start/expiry date, and CCV (3 digit security number). This enables us to process your order and to notify you of your order status. We also ask you for your telephone number. This allows us to make urgent contact with you should there be a problem with your order.
We do not store credit card details nor do we share customer details with any 3rd parties. Our accepted method of payment is via PayPal or debit and credit cards via the PayPal Gateway. We never share your information and your payment is made via the secure PayPal checkout. A PayPal account is not required to make payment using your debit or credit card. All credit card numbers are encrypted in the software when the order is placed using 128 bit encryption. They are only decrypted after they reach our computer. They are not held in clear text on any part of our website.
However, we would like to keep you up to date with our full range of products and services. This includes news of special events, offers, promotions, product launches and catalogues. We may contact you by post, telephone, SMS text messaging and/or email. We are constantly looking for ways to improve our service so; we may occasionally contact you for research purposes. If you wish to be removed from this mailing database please notify us through the Contact Us form.
We confirm that your personal information will only be used in accordance with our Privacy Policy. The personal information you do give us such as home address, e-mail address, telephone may be disclosed to reputable third parties who will help process your order such as courier companies. We may use other companies to provide services on our behalf, including packaging, mailing and delivering purchases, answering customer’s questions’ about products or services, and processing credit card payments. MCW Gear or Hamtons Direct Limited requires all such third parties to treat your personal information as fully confidential and to fully comply with all applicable Data Protection and consumer legislation.
PURCHASER DEFAULT
If the Purchaser (a) commits a breach of contract, or (b) fails to make a payment on the due date, or (c) becomes insolvent or has a receiver or liquidator appointed then, in any such case, the Seller shall be entitled to cancel the contract and repossess any Products for which payment has not been received in full.
LAW & DISPUTES
The contract between Seller and Purchaser is governed by English law.
Any dispute which cannot be settled amicably will be referred to mediation at the request of either party to eBay Resolution Centre.
