They overnight shipped a replacement device and told me to recycle the bad device. Seller goes beyond expectations to resolve issues. Unfortunately the switch turned out to be an mellanox oem but EMC software switch, these switches are notorious to figure out and I do not blame the seller (even I was duped till I went to configure it!). After messaging the seller, I received a fedex return tag promptly. That's customer service! Thanks again.
