§ 1 Geltungsbereich des Vertrages
Die folgenden Allgemeinen Geschäftsbedingungen regeln das Vertragsverhältnis zwischen dem Verkäufer Hubertus Strehlke und dem jeweiligen Käufer auf der Verkaufsplattform eBay im Internet.
§ 2 Vertragsgegenstand
Gegenstand des jeweiligen Vertrages ist der Verkauf von Waren durch den Verkäufer an den Käufer auf der Verkaufsplattform eBay.
Diese Waren werden vom Verkäufer entweder über dessen eBay-Shop als Shop-Artikel oder als allgemeine Auktionsartikel angeboten. Allgemeine Auktionsartikel sind sowohl auf den allgemeinen eBay-Websites als auch im eBay-Shop des Verkäufers sichtbar.
Die auf den allgemeinen eBay-Websites oder im eBay-Shop des Verkäufers eingestellten Warenangebote sind verbindliche Angebote des Verkäufers zum Abschluss eines Kaufvertrages über den jeweiligen Artikel.
§ 3 Vertragsschluss, Vertragssprache
Der Käufer kann über den eBay-Shop des Verkäufers angebotene Ware sofort kaufen oder auf diese Ware im Rahmen einer Auktion bieten. Auktionsangebote können auch mit der Option Sofort-Kaufen verbunden sein. Die im eBay-Shop des Verkäufers im Angebotsformat Sofort-Kaufen angebotene Ware und Auktionen dieser Waren sind auch auf den allgemeinen eBay-Websites sichtbar. Dies gilt nicht für Shop-Artikel des Verkäufers.
Im Fall des Sofort-Kaufs kommt ein wirksamer Kaufvertrag zum Sofort-Kaufen-Preis (Festpreis) zwischen Käufer und Verkäufer zustande, wenn der Käufer die Schaltfläche „Sofort Kaufen" bzw. „Sofort & Neu" anklickt und anschließend bestätigt. Bei Festpreisartikeln, bei denen der Verkäufer die Option „sofortige Bezahlung“ ausgewählt hat, nimmt der Käufer das Angebot an, indem er den Button „Sofort-Kaufen“ anklickt und den unmittelbar nachfolgenden Zahlungsvorgang abschließt. Der Käufer kann Angebote für mehrere Artikel auch dadurch annehmen, dass er die Artikel in den Warenkorb (sofern verfügbar) legt und den unmittelbar nachfolgenden Zahlungsvorgang abschließt. Angebote mit der Option "Sofort Kaufen" kann der Käufer auch als Gast kaufen, ohne sich bei eBay anmelden zu müssen. In diesem Fall nimmt der Käufer das Angebot an, indem er den Button "Sofort-Kaufen" anklickt, auf der folgenden Login-Seite die Option "Weiter als Gast" auswählt und den unmittelbar nachfolgenden Zahlungsvorgang abschließt.
Bei einer Auktion kommt ein wirksamer Kaufvertrag mit demjenigen Käufer zustande, der innerhalb des Angebotszeitraums das höchste Gebot abgeben hat. Die Höhe des Kaufpreises richtet sich nach diesem Höchstgebot. Ein Gebot erlischt, wenn ein anderer Käufer während der Angebotsdauer ein höheres Gebot abgibt.
Ist ein Auktionsangebot zusätzlich mit der Option Sofort-Kaufen versehen, kommt ein wirksamer Kaufvertrag über den Erwerb des Artikels unabhängig vom Ablauf der Angebotszeit und ohne Durchführung einer Auktion bereits dann zum Sofort-Kaufen-Preis (Festpreis) zustande, wenn ein Käufer diese Option ausübt. Die Option kann vom Käufer ausgeübt werden, solange noch kein Gebot auf den Artikel abgegeben oder ein ggf. vom Verkäufer festgelegter Mindestpreis noch nicht erreicht wurde.
Sofern der Verkäufer sein Angebot mit einer Preisvorschlag-Funktion versieht, können Käufer und Verkäufer den Preis für diesen Artikel aushandeln. In der Abgabe des Preisvorschlages durch den Käufer ist dann das verbindliche Angebot und in dem Einverständnis des Verkäufers mit dem Preisvorschlag die verbindliche Annahme des Verkäufers zu sehen.
Der Verkäufer übersendet nach Vertragsschluss dem Käufer eine Bestätigung und Angaben zur Kaufabwicklung.
Vertragssprache ist ausschließlich deutsch. Der Vertragstext wird vom Verkäufer nicht gespeichert und kann nach Abschluss eines Bestellvorgangs (z.B. „Sofort Kaufen“) nicht mehr abgerufen werden. Der Käufer kann die Bestelldaten aber unmittelbar vor dem Abschicken über die Funktionen seines Browsers speichern oder ausdrucken.
§ 4 Widerrufsrecht
Sofern der Käufer Verbraucher ist, steht ihm gesetzlich ein 14-tägiges Widerrufsrecht zu. Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können.
Hinweise zum Widerrufsrecht können der jeweiligen Artikelbeschreibung des Verkäufers entnommen werden. Der Käufer erhält zusätzlich nach Vertragsschluss eine Bestellbestätigung mit einer Belehrung über sein Widerrufsrecht und Informationen dazu, wie er es ausüben kann.
§ 5 Gewährleistung, Haftung
Die Gewährleistung des Verkäufers im Falle eines Mangels der Ware sowie die Haftung des Verkäufers auf Schadensersatz richtet sich nach den gesetzlichen Vorschriften. Tritt der Mangel während des Transports auf, ist Anspruchsgegner das entsprechende Transportunternehmen. Es wird keine Haftung für Personen und Sachschäden übernommen. Alle Angaben Auf Produkten sind dem Hersteller zuzurechnen. Insbesondere bei Elektronischen Bauteilen wird keine Haftung für Fehler, falsche Angaben auf dem Gerät oder dem Datenblatt übernommen. Grundsätzlich haftet der Käufer bei Einsatz der Elektronischen Bauteile vollständig selbst. Elektronische Bauteile dürfen nur von qualifiziertem Fachpersonal benutzt und eingebaut werden.
§ 6 Informationen zur alternativen Streitbeilegung
Die EU-Kommission stellt eine Online-Plattform zur Streitbeilegung ("OS-Plattform") zur Verfügung, die über den Link http://ec.europa.eu/odr erreichbar ist. Sofern der Kunde ein in der Europäischen Union wohnhafter Verbraucher ist, besteht die Möglichkeit, zur außergerichtlichen Beilegung von Streitigkeiten über vertragliche Verpflichtungen aus Online-Kaufverträgen diese Plattform zu nutzen.
Zur Teilnahme an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle ist der Verkäufer nicht verpflichtet und grundsätzlich nicht bereit.
§ 7 Versand
Der Versand erfolgt ausschließlich mittels Deutscher Post oder DHL. Angegebene Lieferzeiten entsprechen den Regellieferzeiten der oben genannten Anbieter. Sollten diese ohne Verschulden des Verkäufers vom obigen Anbieter nicht eingehalten werden, ist der Verkäufer nicht dafür haftbar. Dies stellt außerdem keinen Grund für einen Widerruf dar. Der Verkäufer kommt hierdurch ebenfalls nicht in Verzug.
Anspruchsgegner wird in diesem Fall das mit dem Versand beauftragte Institut.
Gleiches gilt für während des Transports beschädigte Waren.
§ 8 Besteuerung
Als Kleinunternehmen sind wir gemäß § 19 Abs. 1 UStG von der Umsatzsteuer (Mehrwertsteuer) befreit.
Auf alle von uns angebotene Artikel wird keine Umsatzsteuer berechnet. Dementsprechend kann auf Rechnungen keine Umsatzsteuer ausgewiesen werden.
§ 9 Testprodukte / Test-Kits
Der Verkauf von Testprodukten oder Testkits erfolgt unter Ausschluss jeglicher Gewährleistungs- und Haftungsrechte. Wir schließen insbesondere eine Haftung für Falschergebnisse und Folgeschäden aus. Ein Test liefert keine rechtsverbindliche Diagnose. Die Rücknahme von Produkten mit Mindesthaltbarkeitsdatum ist ausgeschlossen.
§ 10 Schlussbestimmungen
Auf die vorliegenden Allgemeinen Geschäftsbedingungen und auf den jeweils geschlossenen Kaufvertrag ist ausschließlich deutsches Recht unter Ausschluss des UN-Kaufrechts anwendbar. Für den Fall, dass der Käufer Verbraucher ist, gilt dies nur insoweit, als nicht der gewährte Schutz durch zwingende Bestimmungen des Rechts des Staates, in dem der Verbraucher seinen gewöhnlichen Aufenthalt hat, entzogen wird.
Sollten eine oder mehrere Klauseln dieser Geschäftsbedingungen ganz oder teilweise unwirksam sein, so soll hierdurch die Gültigkeit der übrigen Bestimmungen nicht berührt sein.

§ 1 Scope of the Agreement
These General Terms and Conditions regulate the contractual relationship between the seller, Hubertus Strehlke, and the respective buyer on the eBay sales platform on the Internet.
§ 2 Subject of the Contract
The subject of the respective contract is the sale of goods by the seller to the buyer on the eBay sales platform.
These goods are offered by the seller either through their eBay store as store items or as general auction items. General auction items are visible both on the general eBay websites and in the seller's eBay store.
The goods offered on the general eBay websites or in the seller's eBay store are binding offers from the seller to conclude a purchase contract for the respective item.
§ 3 Conclusion of the Contract, Language of the Contract
The buyer can either buy the offered goods immediately through the seller's eBay store or bid on these goods within the framework of an auction. Auction offers may also be linked with the "Buy It Now" option. The goods offered in the seller's eBay store in the "Buy It Now" format and auctions for these goods are also visible on the general eBay websites. This does not apply to the seller's store items.
In the case of a "Buy It Now" purchase, a valid purchase contract is concluded at the "Buy It Now" price (fixed price) between the buyer and the seller when the buyer clicks the "Buy It Now" or "Buy It Now & New" button and subsequently confirms the purchase. For fixed-price items where the seller has selected the "immediate payment" option, the buyer accepts the offer by clicking the "Buy It Now" button and completing the immediate payment process that follows. The buyer can also accept offers for multiple items by adding them to the shopping cart (if available) and completing the payment process immediately after. Offers with the "Buy It Now" option can also be purchased by the buyer as a guest without logging into eBay. In this case, the buyer accepts the offer by clicking the "Buy It Now" button, selecting the "Continue as Guest" option on the following login page, and completing the payment process immediately.
In an auction, a valid purchase contract is concluded with the buyer who has placed the highest bid within the auction period. The purchase price is determined by this highest bid. A bid expires if another buyer places a higher bid during the auction period.
If an auction offer is additionally provided with the "Buy It Now" option, a valid purchase contract for the purchase of the item will be concluded at the "Buy It Now" price (fixed price), regardless of the expiration of the auction period, as soon as a buyer uses this option. The option can be exercised by the buyer as long as no bid has been placed on the item or the seller's minimum price (if any) has not yet been reached.
If the seller provides the offer with a "Best Offer" function, the buyer and seller can negotiate the price for this item. In the submission of a price proposal by the buyer, it is considered a binding offer, and the seller's acceptance of the price proposal is seen as a binding acceptance.
After the contract is concluded, the seller will send the buyer a confirmation and information on how to proceed with the purchase.
The language of the contract is exclusively German. The contract text is not stored by the seller and cannot be retrieved after the order process (e.g. "Buy It Now") has been completed. However, the buyer can save or print the order data immediately before submitting them through the functions of their browser.
§ 4 Right of Withdrawal
If the buyer is a consumer, they are legally entitled to a 14-day right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their commercial or self-employed professional activity.
Instructions on the right of withdrawal can be found in the respective item description of the seller. Additionally, the buyer will receive an order confirmation after the contract is concluded, along with information on how to exercise their right of withdrawal.
§ 5 Warranty, Liability
The seller's warranty in the event of a defect in the goods and the seller's liability for damages are governed by the statutory provisions. If the defect occurs during transport, the corresponding transport company is the party to claim against. No liability is assumed for personal injury or property damage. All product details are attributable to the manufacturer. In particular, for electronic components, no liability is assumed for errors, incorrect information on the device or data sheet. The buyer assumes full responsibility for the use of electronic components. Electronic components should only be used and installed by qualified personnel.
§ 6 Information on Alternative Dispute Resolution
The European Commission provides an online platform for dispute resolution ("ODR Platform"), which can be accessed via the link: http://ec.europa.eu/odr. If the customer is a consumer residing in the European Union, there is the possibility to use this platform for the out-of-court settlement of disputes regarding contractual obligations arising from online purchase contracts.
The seller is neither obliged nor generally willing to participate in a dispute resolution procedure before a consumer dispute resolution body.
§ 7 Shipping
Shipping is exclusively carried out via Deutsche Post or DHL. The indicated delivery times correspond to the regular delivery times of the above-mentioned providers. If these are not adhered to due to circumstances beyond the seller's control, the seller will not be held liable. This also does not constitute grounds for withdrawal. The seller will not be in default due to this. In this case, the party responsible for the shipping is the shipping company. The same applies to goods damaged during transport.
§ 8 Taxation
As a small business under § 19 (1) of the German VAT Act (UStG), we are exempt from VAT.
No VAT will be charged on the items we offer. Consequently, no VAT will be shown on invoices.
§ 9 Test Products / Test Kits
The sale of test products or test kits is carried out under the exclusion of any warranty and liability rights. We specifically exclude liability for incorrect results and consequential damages. A test does not provide a legally binding diagnosis. Returns of products with an expiration date are excluded.
§ 10 Final Provisions
These General Terms and Conditions and the respective concluded purchase contract are governed exclusively by German law, excluding the UN Sales Convention.
In the event that the buyer is a consumer, this only applies to the extent that mandatory provisions of the law of the country in which the consumer has their habitual residence are not overridden.
Should one or more clauses of these Terms and Conditions be wholly or partially invalid, this shall not affect the validity of the remaining provisions.
