1. Scope of application
The following General Terms and Conditions apply to all orders placed through our eBay shop by consumers and businesses.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or self-employed professional activity.
A business is a natural or legal person, or a partnership with legal capacity, that enters into a legal transaction in the course of its commercial or self-employed professional activity.
For businesses, the following applies: If the business uses conflicting or supplementary general terms and conditions, their validity is hereby rejected. They only become part of the contract if we have expressly agreed to them.
2. Contracting party, conclusion of contract, correction options
2.1 Contracting party
The purchase contract is concluded with Autocirc Ådalens Bildemontering AB.
2.2 Conclusion of contract
When we list a product in auction or fixed-price format, we make a binding offer to conclude a contract for that product. We determine the starting or fixed price and the offer duration, meaning the period within which the offer can be accepted.
In auction format, if we set a minimum price, the offer is subject to the condition that the minimum price is reached. Auction listings may also include a “Buy It Now” function, which you can use as long as no bid has been placed or the minimum price has not yet been reached.
In auction format, you accept the offer by placing a bid. Acceptance is subject to the condition that you are the highest bidder when the listing ends. Your bid expires if another buyer places a higher bid during the listing period.
In fixed-price format, you accept the offer by clicking “Buy It Now” and confirming the purchase. If immediate payment is required, you accept the offer by clicking “Buy It Now” and completing the payment process immediately afterwards.
You may also accept offers for several products by placing them in the shopping cart, if available, and completing the payment process.
If the “Send price proposal” option is available, you may suggest a price at which you would buy the product. We may accept, reject, or make a counteroffer. By submitting a price proposal, you make a binding offer to buy the product at the proposed price. Your proposal is valid for up to 48 hours or until the listing ends, whichever occurs first. If we accept it, a binding contract is concluded. The price proposal generally only relates to the price of the offered product.
2.3 Correction options
Before submitting the order, you can identify and correct your entries using the tools provided by eBay during the order process.
To cancel a transaction, use your browser’s “Back” button to return to the item page or eBay shopping cart. In the cart, you can change the quantity or remove an item by clicking “Remove”. Input errors can also be corrected by cancelling the purchase process.
3. Warranty & Liability for Defects
Unless expressly agreed otherwise below, statutory liability for defects applies.
As we sell used auto parts, the statutory warranty period for defects is limited to 12 months from the date of delivery for both consumers and businesses, as permitted by German law.
The statutory warranty applies only to defects that were present at the time of delivery.
The warranty does not cover:
• normal wear and tear,
• damage caused by improper use, incorrect or unauthorized installation,
• incompatibility due to incorrect part selection,
• damage caused after delivery,
• items that have been modified, tampered with or installed.
The buyer is responsible for verifying compatibility before purchase, installation, and use. Part numbers, OEM numbers, compatibility lists, and vehicle application information are provided for reference purposes only and do not constitute a guarantee of fitment. Compatibility information may occasionally contain errors or inaccuracies.
We strongly recommend contacting us before purchase to confirm compatibility. If a part is ordered without prior compatibility confirmation from us and later proves incompatible with the buyer’s vehicle, the buyer is responsible for the return shipping costs.
All parts must be installed in accordance with the manufacturer’s instructions and applicable industry standards. Where programming, coding, calibration, or configuration is required for proper functionality, installation must be carried out by a qualified workshop with the appropriate equipment.
If a delivered item is incomplete, defective, or not as described, the buyer must contact us via eBay messages before returning the item. We may request photos or other documentation of the issue before approving a warranty claim or return.
At our discretion, we may:
• provide a replacement part, subject to availability,
• or issue a full or partial refund.
For approved warranty claims, return shipping costs will be covered by the seller. Return shipping arrangements must be agreed with us in advance before the item is returned.
To the extent permitted by applicable law, the warranty does not cover installation costs, removal costs, diagnostic costs, workshop labor, towing expenses, vehicle downtime, rental vehicles, or any indirect or consequential damages.
The limitations and shortened periods above do not apply to claims based on damage caused by us, our legal representatives, or agents in cases of:
• injury to life, body, or health,
• intentional or grossly negligent breach of duty,
• fraudulent intent,
• breach of essential contractual obligations,
• agreed guarantees,
• or where mandatory product liability laws apply.
For businesses, only our own information and the manufacturer’s product descriptions included in the contract are deemed agreed characteristics of the goods. We assume no liability for public statements made by manufacturers or other advertising claims.
The statutory limitation periods for recourse claims under §445a of the German Civil Code remain unaffected.
For merchants, the inspection and notification obligation under §377 of the German Commercial Code (HGB) applies. If notice is not given as required, the goods are deemed approved unless the defect was not detectable during inspection. This does not apply where a defect has been fraudulently concealed.
4. Liability
We are always fully liable for claims based on damage caused by us, our legal representatives, or agents in cases of injury to life, body, or health; intentional or grossly negligent breach of duty; agreed guarantees; or where product liability law applies.
5. Customer service
Customer service is available Monday to Friday via eBay messages. We respond to inquiries as quickly as possible. Questions may be submitted in German, but replies will be provided in English.
6. Subject matter of the contract
6.1 Product description
The relevant product description forms an essential part of the contract.
6.2 Product images
Without prejudice to your statutory warranty rights, we would like to point out the following: due to individual screen settings, such as resolution and brightness, minor differences between the displayed and actual product colours may occur. If you are unsure, please contact us.
7. Delivery conditions
7.1 Delivery options
We ship products to the delivery address provided during the order process.
We only deliver by shipping. Collection by the customer is unfortunately not possible.
We do not deliver to parcel stations.
7.2 Delivery by freight carrier
For freight deliveries, the freight company commissioned by us will contact you to arrange a delivery appointment.
Delivery consists only of transport and unloading of the goods at the first public curbside of the agreed delivery address. Delivery does not include transport into specific rooms, assembly, or installation of the ordered goods unless expressly agreed otherwise.
8. Payment
8.1 Prices
The prices stated at the time of order apply. These are total prices and include statutory VAT.
8.2 Payment methods
The following payment methods are generally available in our shop. Payment is processed by eBay:
PayPal, direct debit via PayPal, Apple Pay, Google Pay, credit card, Klarna invoice, Klarna credit card, Klarna direct debit, Klarna instalment purchase, and Sofort / instant bank transfer via Klarna.
The exact payment process, checks, and availability depend on the respective payment provider and the options shown during the eBay checkout process.
9. Right of withdrawal
You have the statutory right of withdrawal as described in the withdrawal policy.
10. Transport damage
For consumers: If goods are delivered with obvious transport damage, please report such defects to the delivery company as soon as possible and contact us without delay.
Failure to make a complaint or contact us has no effect on your statutory rights or their enforcement, especially your warranty rights. However, doing so helps us assert our own claims against the carrier or transport insurance.
11. Dispute resolution
We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
12. Final provisions
If you are a business, German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
If individual clauses of these General Terms and Conditions are wholly or partly invalid, the rest of the contract remains valid. Where individual clauses are invalid, the content of the contract is governed by statutory provisions.
