Terms and Conditions (T&C) for International eBay Sales
1. Scope of Application
These Terms and Conditions (T&C) apply to all international sales, deliveries, and services provided through our eBay store. Any deviating terms and conditions of the buyer are not recognized unless we have explicitly agreed to them in writing.
2. Conclusion of Contract
By listing a product on eBay, we make a binding offer to enter into a purchase contract. The contract is concluded when the buyer accepts the offer via the eBay platform (e.g., by clicking “Buy It Now”).
3. Prices and Payment
All prices are final prices and include all applicable taxes unless otherwise stated. Shipping costs are displayed separately. Payment is due immediately and must be made via one of the payment methods supported by eBay.
4. Shipping and Delivery
Products are shipped to the delivery address provided by the buyer. Delivery times vary depending on the destination country.
We are not responsible for delays caused by customs processing or local carriers. The buyer is responsible for any applicable import duties, taxes, or fees incurred in the destination country.
5. Return Policy / Withdrawal
We do not generally accept returns. Buyers are therefore requested to carefully review the item description and images before making a purchase.
Returns are only accepted under the following strict conditions:
The product is defective, damaged in transit, or not as described;
The buyer contacts us within 7 days of receiving the item;
The return is authorized in writing by us in advance;
The item is returned in unused and original condition.
All return shipping costs must be covered by the buyer. Unauthorized returns will not be accepted or refunded.
For buyers within the European Union:
We reserve the right to limit the statutory right of withdrawal where legally permissible. If a right of withdrawal applies, detailed instructions will be provided separately.
6. Condition of Items
Unless otherwise stated, all products are sold as new. In case of used goods, condition and defects (if any) will be described to the best of our knowledge.
7. Warranty
Legal warranty rights apply. For used goods, the warranty period is limited to 12 months unless otherwise required by law.
Warranty claims require prior written notice and must be made without undue delay upon discovering the defect.
8. Limitation of Liability
We are liable for damages only in cases of willful misconduct or gross negligence. For simple negligence, we are liable only in cases of breach of essential contractual obligations (“cardinal obligations”) and only for foreseeable damages.
We are not liable for:
Loss of profits or indirect damages;
Delivery delays due to force majeure;
Errors caused by third-party delivery services or customs clearance delays.
9. Data Protection
We process personal data in accordance with the applicable data protection regulations (GDPR, if applicable). Personal data is used solely for contract execution and will not be shared with third parties except where necessary (e.g., shipping providers).
10. Customs, Duties, and Taxes
International buyers are solely responsible for compliance with local import regulations and for payment of all customs duties, import taxes, and other applicable fees. Refused shipments due to unpaid duties or non-compliance may not be refunded.
11. Applicable Law and Jurisdiction
All contractual relationships shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If the buyer is a merchant or a legal entity under public law, the exclusive jurisdiction shall be our place of business in Germany.
12. Final Provisions
Should any provision of these T&C be or become invalid, this shall not affect the validity of the remaining provisions. In such a case, the invalid provision shall be replaced by a valid one that comes as close as possible to the intended purpose.
Allgemeine Geschäftsbedingungen (AGB)
1. Geltungsbereich
Diese AGB gelten für alle Verkäufe, Lieferungen und Leistungen, die über unseren eBay-Shop an internationale Käufer erfolgen. Abweichende Bedingungen des Käufers werden nicht anerkannt, es sei denn, wir stimmen ihrer Geltung ausdrücklich schriftlich zu.
2. Vertragsschluss
Mit dem Einstellen eines Artikels auf eBay geben wir ein verbindliches Angebot zum Abschluss eines Kaufvertrages über diesen Artikel ab. Der Vertrag kommt zustande, sobald ein Käufer das Angebot über die eBay-Plattform annimmt (z. B. durch Klick auf „Kaufen“ oder „Sofort-Kaufen“).
3. Preise und Zahlung
Alle Preise verstehen sich als Endpreise zuzüglich ggf. anfallender Versandkosten. Zahlungen sind sofort fällig. Die Zahlungsabwicklung erfolgt über die von eBay angebotenen Zahlungsmethoden.
4. Lieferung
Die Lieferung erfolgt an die vom Käufer angegebene Lieferadresse. Die Lieferzeit hängt vom Zielland ab. Für Verzögerungen durch Zoll oder Transportdienstleister übernehmen wir keine Haftung.
5. Rücknahme / Rückgaberecht
Wir akzeptieren Rückgaben nur in Ausnahmefällen und nach vorheriger schriftlicher Vereinbarung.
Ein allgemeines Widerrufsrecht wird nicht gewährt, es sei denn, gesetzliche Bestimmungen sehen dies zwingend vor.
Rückgaben wegen Nichtgefallens, falscher Größe oder Meinungsänderung sind ausgeschlossen.
Im Fall einer genehmigten Rückgabe trägt der Käufer sämtliche Rücksendekosten. Artikel müssen unbenutzt, originalverpackt und innerhalb von 7 Tagen nach Erhalt retourniert werden.
6. Gewährleistung
Es gelten die gesetzlichen Gewährleistungsrechte. Bei gebrauchten Waren beträgt die Gewährleistungsfrist 12 Monate, sofern keine andere Frist gesetzlich vorgeschrieben ist.
7. Haftung
Wir haften nur für Schäden, die auf vorsätzlicher oder grob fahrlässiger Pflichtverletzung beruhen. Für einfache Fahrlässigkeit haften wir nur bei Verletzung wesentlicher Vertragspflichten (Kardinalpflichten).
8. Datenschutz
Personenbezogene Daten werden ausschließlich zur Vertragsabwicklung verwendet und nicht an Dritte weitergegeben, es sei denn, dies ist zur Vertragserfüllung erforderlich (z. B. Versanddienstleister).
9. Gerichtsstand und anwendbares Recht
Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts. Gerichtsstand ist, soweit zulässig, unser Geschäftssitz.
10. Schlussbestimmungen
Sollten einzelne Bestimmungen dieser AGB ganz oder teilweise unwirksam sein, bleibt die Gültigkeit der übrigen Bestimmungen unberührt.
