1. General
1.1 Provider
trad4u_online is a service of the company SXC EUROPE with head office: Rochesterlaan 11, 8470 Gistel Belgium. (No returns at headquarters, all packages to this address will be refused).

1.2 Validity of the GTC
All business relations arising between SXC EUROPE BVBA and its customers are conducted on the basis of the following General Terms and Conditions (GTC) in the version valid at the time of the order, unless individual contractual agreements have been made. Individual contractual agreements take precedence over these General Terms and Conditions.
1.3 Bidder and Customer / Consumer and Entrepreneur
Bidder or customer in the sense of these terms and conditions is both the consumer and the entrepreneur, unless otherwise specified. According to § 13 of the German Civil Code (Bürgerliches Gesetzbuch), a consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity. Pursuant to Section 14 of the German Civil Code, an entrepreneur is a natural person or legal entity (e.g. limited liability company, stock corporation) or a partnership with legal capacity (e.g. limited partnership, partnership under civil law, general partnership) which, when concluding a legal transaction, acts in the exercise of its commercial or independent professional activity.
Insofar as the person of the "Bidder" or "Customer" is referred to in the masculine form, this also refers to the female Bidder or Customer.
2. conclusion of the contract
2.1 Start Price Auction
In the start price auction, several bidders can bid on an item offered by specifying a concrete price. If another bidder places a higher bid during the online auction, the bid of the bidder who placed a lower bid earlier shall expire. 2.1.1 Offer
The placement of the goods by SXC EUROPE BVBA on eBay for the purpose of conducting a starting price auction constitutes an offer to conclude a contract. SXC EUROPE BVBA determines for each start price auction a time limit within which the offer can be accepted by the bid of a bidder. SXC EUROPE BVBA directs the offer to the bidder who (1) submits the highest bid during the online auction and (2) fulfills all additional conditions determined by SXC EUROPE BVBA in the offer (in particular evaluation criteria).
2.1.2 Acceptance / Detection and Correction of Input Errors
In order to accept a starting price offer from SXC EUROPE BVBA, the bidder must submit a bid. For this purpose, the following technical steps are required:
The bidder clicks on the blue "Bid" button located next to the price in the item description.
A two-part input mask will now open. The eBay member name and the eBay password chosen by the bidder must be entered in this mask. If the bidder is already registered as an eBay member, he enters his eBay member name and then his eBay password in the input mask. If he is not registered yet, he has to log in to eBay first. To do this, click on the "Log in" button.
As the next step, the bidder shall click the "Secure Login" button.

1.2 Geltung der AGB
Alle Geschäftsbeziehungen, welche zwischen SXC EUROPE BVBA und deren Kunden entstehen, werden auf der Grundlage der nachfolgenden Allgemeinen Geschäftsbedingungen (AGB) in ihrer zum Zeitpunkt der Bestellung gültigen Fassung geführt, soweit keine individuellen Vertragsabreden getroffen sind. Individuelle Vertragsabreden gehen diesen Allgemeinen Geschäftsbedingungen vor.
1.3 Bieter und Kunde / Verbraucher und Unternehmer
Bieter oder Kunde im Sinne dieser Geschäftsbedingungen ist sowohl der Verbraucher als auch der Unternehmer, soweit etwas anderes nicht bestimmt ist. Gemäß § 13 Bürgerliches Gesetzbuch ist Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbstständigen beruflichen Tätigkeit zugerechnet werden können. Gemäß § 14 Bürgerliches Gesetzbuch ist Unternehmer eine natürliche Person oder juristische Person (z.B. Gesellschaft mit beschränkter Haftung, Aktiengesellschaft) oder eine rechtsfähige Personengesellschaft (z.B. Kommanditgesellschaft, Gesellschaft bürgerlichen Rechts, offene Handelsgesellschaft), die bei Abschluss eines Rechtsgeschäfts in Ausübung ihrer gewerblichen oder selbständigen beruflichen Tätigkeit handelt.
Soweit von der Person des „Bieters“ oder „Kunden“ in männlicher Form die Rede ist, ist hiermit auch die weibliche Bieterin oder Kundin gemeint.
2. Zustandekommen des Vertrages
2.1 Startpreis-Auktion
Bei der Startpreis-Auktion können mehrere Bieter auf eine angebotene Ware durch Angabe eines konkreten Preises mitbieten. Gibt ein anderer Bieter während der Online-Auktion ein höheres Gebot ab, erlischt das Gebot des zeitlich früher mit einem niedrigeren Gebot in Erscheinung getretenen Bieters. Für die Messung der Dauer einer Online-Auktion gilt die offizielle eBay-Zeit als maßgebend vereinbart. Ein Vertrag über die von SXC EUROPE BVBA bei eBay eingestellte Ware kommt mit dem Bieter des höchsten Gebotes zustande, wenn entweder die von SXC EUROPE BVBA bestimmte Laufzeit abgelaufen ist oder die Auktion von SXC EUROPE BVBA vorzeitig beendet wurde.
2.1.1 Angebot
Die Einstellung der Ware durch SXC EUROPE BVBA bei eBay zur Durchführung einer Startpreis-Auktion stellt ein Angebot zum Vertragsschluss dar. SXC EUROPE BVBA bestimmt für jede Startpreis-Auktion eine Frist, binnen derer das Angebot durch das Gebot eines Bieters angenommen werden kann. SXC EUROPE BVBA richtet das Angebot an den Bieter, der (1) während der Online-Auktion das höchste Gebot abgibt und (2) alle zusätzlich von SXC EUROPE BVBA bestimmten Bedingungen im Angebot (insbesondere Bewertungskriterien) erfüllt.
2.1.2 Annahme / Erkennung und Berichtigung von Eingabefehlern
Um ein Startpreis-Angebot von SXC EUROPE BVBA anzunehmen, hat der Bieter ein Gebot abzugeben. Hierzu sind folgende technische Schritte erforderlich:
a. Der Bieter klickt in der Artikelbeschreibung auf die blaue Taste „Bieten“, die sich neben dem Preis befindet.
b. Es öffnet sich nun eine zweiteilige Eingabemaske. In diese ist der eBay-Mitgliedsname und das vom Bieter gewählte eBay-Passwort einzugeben. Ist der Bieter bereits als eBay-Mitglied registriert, gibt er in die Eingabemaske seinen eBay-Mitgliedsnamen und sodann sein eBay-Passwort ein. Ist er noch nicht registriert, hat er sich zuvor bei eBay anzumelden. Hierzu klickt auf die Taste „Anmelden“.
c. Als nächsten Schritt hat der Bieter die Taste „Sicheres Einloggen“ anzuklicken.
d. Es öffnet sich nun eine Übersicht mit Artikelbezeichnung, Start-Preis, Verpackungs- und Versandkosten und Zahlungsmethoden. Hier kann der Bieter überprüfen, ob der Vertragsinhalt (Ware) und die Vertragsbedingungen seinen Erwartungen entsprechen. Ist dies nicht der Fall, so kann der Bieter das Fenster schließen. Eine anderweitige Berichtigung der Bestellung als durch Abbruch des Bestellvorgangs ist dem Kunden nicht möglich. Entsprechen der Vertragsinhalt (Ware) und die Vertragsbedingungen seinen Erwartungen, so kann der Bieter im Eingabefeld „Maximalgebot“ sein Maximalgebot für die von SXC EUROPE BVBA angebotene Ware eingeben. Das Maximalgebot muss mindestens 1,99 EUR betragen, wobei die Eingabe ohne 1000er-Trennzeichen (z.B. 1000,00) zu erfolgen hat.
e. Um sein Gebot zu bestätigen, hat der Bieter nunmehr die Taste „Bestätigen“ zu aktivieren.
f. Im Folgenden übernimmt die Firma eBay die Gebotsabgabe für den Anbieter, und zwar so lange bis sein Maximalgebot erreicht ist. Der Bieter erhält von eBay eine E-Mail, die sein Gebot bestätigt. Nach Angebotsende erhält der Bieter

1.2 Validité des CGV
Toutes les relations d'affaires entre SXC EUROPE BVBA et ses clients se déroulent sur la base des conditions générales de vente (CGV) suivantes, dans la version en vigueur au moment de la commande, sauf si des accords contractuels individuels ont été conclus. Les accords contractuels individuels priment sur les présentes conditions générales.
1.3 Soumissionnaire et client / Consommateur et entrepreneur
L'enchérisseur ou le client au sens des présentes conditions générales est à la fois le consommateur et l'entrepreneur, sauf indication contraire. Conformément à l'article 13 du code civil allemand (Bürgerliches Gesetzbuch), un consommateur est toute personne physique qui conclut un acte juridique à des fins qui ne peuvent être attribuées de manière prépondérante ni à son activité commerciale ni à son activité professionnelle indépendante. Conformément à l'article 14 du code civil allemand, un entrepreneur est une personne physique ou une entité juridique (par exemple, une société à responsabilité limitée, une société par actions) ou une société de personnes dotée de la capacité juridique (par exemple, une société en commandite, une société de droit civil, une société en nom collectif) qui, lorsqu'elle conclut un acte juridique, agit dans l'exercice de son activité commerciale ou professionnelle indépendante.
Dans la mesure où la personne de l'"Offrant" ou du "Client" est désignée au masculin, cela concerne également l'Offrante ou la Cliente.
2. Conclusion du contrat
2.1 Prix de départ de l'enchère
Dans l'enchère à prix initial, plusieurs enchérisseurs peuvent faire une offre sur un article proposé en spécifiant un prix concret. Si un autre enchérisseur fait une offre plus élevée au cours de l'enchère en ligne, l'offre de l'enchérisseur qui a fait une offre inférieure plus tôt expire. Pour la mesure de la durée d'une enchère en ligne, l'heure officielle d'eBay fait foi. Un contrat portant sur les biens proposés par SXC EUROPE BVBA sur eBay est conclu avec le soumissionnaire ayant fait l'offre la plus élevée, si la durée déterminée par SXC EUROPE BVBA a expiré ou si l'enchère a été interrompue prématurément par SXC EUROPE BVBA.
2.1.1 Offre
Le placement de la marchandise par SXC EUROPE SPRL sur eBay dans le but de réaliser une enchère à prix de départ constitue une offre de conclure un contrat. SXC EUROPE SPRL détermine pour chaque enchère à prix de départ un délai dans lequel l'offre peut être acceptée par l'offre d'un enchérisseur. SXC EUROPE SPRL adresse l'offre à l'enchérisseur qui (1) soumet l'offre la plus élevée pendant la vente aux enchères en ligne et (2) remplit toutes les conditions supplémentaires déterminées par SXC EUROPE SPRL dans l'offre (notamment les critères d'évaluation).
2.1.2 Acceptation / Détection et correction des erreurs de saisie
Afin d'accepter une offre de prix de départ de SXC EUROPE BVBA, le soumissionnaire doit soumettre une offre. À cette fin, les étapes techniques suivantes sont requises :
L'enchérisseur clique sur le bouton bleu "Enchérir" situé à côté du prix dans la description de l'article.
Un masque de saisie en deux parties s'ouvre alors. Le nom de membre eBay et le mot de passe eBay choisis par l'enchérisseur doivent être saisis dans ce masque. Si l'enchérisseur est déjà enregistré en tant que membre eBay, il saisit son nom de membre eBay puis son mot de passe eBay dans le masque de saisie. S'il n'est pas encore enregistré, il doit d'abord se connecter à eBay. Pour ce faire, il doit cliquer sur le bouton "Log in".
À l'étape suivante, le soumissionnaire doit cliquer sur le bouton "Connexion sécurisée".
Une vue d'ensemble avec la description de l'article, le prix de départ, les frais d'emballage et d'expédition et les modes de paiement s'ouvre alors. L'enchérisseur peut y vérifier si le contenu du contrat (marchandises) et les conditions du contrat correspondent à ses attentes. Si ce n'est pas le cas, l'enchérisseur peut fermer la fenêtre. Il n'est pas possible pour le client de corriger la commande autrement qu'en annulant le processus de commande. Si le contenu du contrat (marchandises) et les conditions du contrat répondent à ses attentes, l'enchérisseur peut saisir son offre maximale pour les marchandises proposées par SXC EUROPE BVBA dans le champ de saisie "Offre maximale". L'offre maximale doit être d'au moins 1,99 EUR, la saisie devant être effectuée sans séparateur de 1000 (par exemple 1000,00).
Pour confirmer son offre, l'enchérisseur doit maintenant activer le bouton "Confirmer".
Dans le cas suivant, eBay prend en charge l'enchère pour l'enchérisseur jusqu'à ce que son offre maximale soit atteinte. L'enchérisseur reçoit un e-mail d'eBay confirmant son offre. Après la fin de l'enchère, l'enchérisseur reçoit.

Tutte le relazioni d'affari tra SXC EUROPE BVBA e i suoi clienti si svolgono sulla base delle seguenti Condizioni Generali (CG) nella versione valida al momento dell'ordine, a meno che non siano stati conclusi accordi contrattuali individuali. Gli accordi contrattuali individuali hanno la precedenza sulle presenti Condizioni Generali.
1.3 Offerente e cliente / consumatore e imprenditore
L'offerente o cliente nel senso di questi termini e condizioni è sia il consumatore che l'imprenditore, se non diversamente specificato. Secondo il § 13 del Codice Civile Tedesco (Bürgerliches Gesetzbuch), un consumatore è qualsiasi persona fisica che stipula un negozio giuridico per scopi che non possono essere prevalentemente attribuiti né alla sua attività commerciale né alla sua attività professionale indipendente. Ai sensi dell'articolo 14 del codice civile tedesco, un imprenditore è una persona fisica o una persona giuridica (ad esempio una società a responsabilità limitata, una società per azioni) o una società con capacità giuridica (ad esempio una società in accomandita semplice, una società di diritto civile, una società in nome collettivo) che, quando conclude un negozio giuridico, agisce nell'esercizio della sua attività commerciale o professionale indipendente.
Nella misura in cui la persona dell'"Offerente" o del "Cliente" si riferisce alla forma maschile, questo si riferisce anche alla donna Offerente o Cliente.
2. Conclusione del contratto
2.1 Prezzo d'inizio asta
Nell'asta a prezzo di partenza, diversi offerenti possono fare offerte su un oggetto offerto specificando un prezzo concreto. Se un altro offerente fa un'offerta più alta durante l'asta online, l'offerta dell'offerente che ha fatto un'offerta più bassa in precedenza scade. Per la misurazione della durata di un'asta online, il tempo ufficiale di eBay è concordato come autorevole. Un contratto per i beni elencati da SXC EUROPE BVBA su eBay è concluso con l'offerente che ha fatto l'offerta più alta, se la durata determinata da SXC EUROPE BVBA è scaduta o se l'asta è stata terminata prematuramente da SXC EUROPE BVBA.
2.1.1 Offerta
L'inserimento dei beni da parte di SXC EUROPE BVBA su eBay allo scopo di condurre un'asta a prezzo di partenza costituisce un'offerta per concludere un contratto. SXC EUROPE BVBA determina per ogni asta a prezzo di partenza un limite di tempo entro il quale l'offerta può essere accettata da un offerente. SXC EUROPE BVBA indirizza l'offerta all'offerente che (1) presenta l'offerta più alta durante l'asta online e (2) soddisfa tutte le condizioni aggiuntive determinate da SXC EUROPE BVBA nell'offerta (in particolare i criteri di valutazione).
2.1.2 Accettazione / Rilevamento e correzione degli errori di input
Per accettare un'offerta di prezzo di partenza di SXC EUROPE BVBA, l'offerente deve presentare un'offerta. A tal fine, sono necessari i seguenti passi tecnici:
